Energy Sharing (DL 15/2022 Art. 87)

The EGAC (Collective Self-Consumption Management Entity) must inform the grid operator of the method used to share the energy produced, which may be based on fixed coefficients, variable coefficients, or a combination of both, in accordance with the regulations of ERSE (Energy Services Regulatory Authority). Sharing can also be carried out using dynamic management systems, which allow real-time monitoring and optimization of energy flows. ERSE regulates the technical details, penalties for non-compliance, and the impacts on billing, ensuring transparency and efficiency in the sharing process.

Dutch Energy Act (Energiewet) 2024

The Dutch Energy Act (Energiewet), adopted in December 2024 and entering into force on 2026-01-01, establishes the main legal framework for the electricity and gas sectors in the Netherlands, replacing the Electricity Act 1998 and Gas Act.

Regarding energy communities, it states:

-Formal recognition of energy communities as market participants;

-Enables energy communities to generate, store, consume, and sell electricity;

-Introduces energy sharing as a legal activity for citizens and communities;

-Allows participation in flexibility mechanisms, aggregation, and congestion management;

-Supports active customers and decentralized energy systems;

-Provides the possibility for peer-to-peer energy interactions under regulatory oversight;

-Aims to improve efficiency of grid usage and address congestion issues;

-Further implementation is defined through secondary legislation (Energy Decree and Energy Regulation).
